Terms of Service

This document governs your use of WhisperWatch. By adding the bot to a server or using the dashboard, you agree to these terms. Please read them carefully. This English text is a translation provided for convenience; the French version prevails in case of discrepancy.

1. Acceptance of terms

By inviting the WhisperWatch bot to a Discord server, signing in to the dashboard, or using any of its features, you acknowledge that you have read, understood and accepted these Terms of Service (the "Terms"). If you do not agree, do not use the service.

2. Description of the service

WhisperWatch is an uptime monitoring service for Discord bots. It observes the presence status of the bots you configure, sends notifications when their state changes (online / offline), records an incident history, and provides statistics as well as a web dashboard. The service is provided "as is" and may change, be suspended, or be discontinued at any time.

3. Access conditions

Use of the service requires a Discord account and compliance with Discord's Terms of Service. Configuring monitoring for a bot on a server requires the Discord "Manage Server" (Manage Server) permission. You are responsible for actions taken through your account.

4. Acceptable use

You agree not to:

  • use the service for unlawful purposes or in violation of Discord's rules;
  • attempt to circumvent access controls, or to disrupt or overload the infrastructure (unauthorized penetration testing, denial of service, abusive automation);
  • monitor bots or servers without being entitled to do so;
  • resell, redistribute, or commercially exploit the service without written authorization.

5. Free and Premium plans

WhisperWatch offers a free plan and optional Premium features. Pricing, limits, and any payment terms are presented at the time of subscription. Unless stated otherwise, payments are non-refundable once the billing period has started. The features included in each plan may be adjusted.

6. Availability and no warranty

The service is provided "as is" and "as available", without warranty of any kind, express or implied. We do not guarantee uninterrupted availability, the accuracy of status data, or the absence of errors. WhisperWatch depends on the Discord API, over which we have no control. No service level agreement (SLA) is guaranteed unless separately agreed in writing.

7. Data and privacy

To operate, WhisperWatch processes a minimal amount of data: Discord identifiers (user, server, bot, channel), the monitoring configuration you define, and an incident and statistics history. Signing in to the dashboard relies on Discord OAuth2 (identify and guilds scopes).

  • You can remove the monitoring of a bot at any time via /unwatch or the dashboard.
  • Monitored bot leaving a server: if a bot you monitor is no longer present on the server, monitoring is paused and its data (configuration, incident history and statistics) is retained for 30 days. If it returns before then, its data is preserved; after 30 days of continuous absence, the data is automatically and permanently deleted.
  • WhisperWatch removed from a server: likewise, all of the server's data is retained for 30 days (to allow re-invitation without loss of configuration) and then automatically deleted.
  • We do not sell your data and use it solely for the purposes of the service.
  • Administrative access: the operator has a secured administration dashboard, reserved to them, allowing them to view configurations and operational data for the purposes of operation, support and abuse prevention. Any modification of a server's configuration by the operator requires the prior consent of the user who set it up: this consent is requested via a Discord direct message and authorizes editing for at most one hour.

8. Intellectual property

WhisperWatch, its name, logo, interface, and code remain the property of their author. These Terms grant you no ownership rights over the service.

9. Limitation of liability

To the extent permitted by law, WhisperWatch and its author shall not be liable for any direct or indirect damages arising from the use of, or inability to use, the service, including data loss, missing notifications, undetected downtime, or any consequence of a Discord outage.

10. Termination

You may stop using the service at any time by removing the bot from your servers. We reserve the right to suspend or terminate access to the service in the event of a breach of these Terms, without notice.

11. Changes to the terms

These Terms may be updated at any time. The last-updated date appears at the top of this page. Continued use of the service after a change constitutes acceptance of the new Terms.

12. Governing law and contact

These Terms are governed by French law. Failing an amicable resolution, the French courts shall have jurisdiction. The French version of these Terms is authoritative; any translation (including this English one) is provided for information only.
